Frequently Asked Questions
Booking:
All of our booking can be done directly via the "Book Now" button at the bottom of the page. Payment-in-full is taken at the time of booking to reduce the cost of transaction fees and to confirm serious reservations. Booking can be done up to two days before your session. If you need to get in sooner, please contact us to check our availability.
Payments:
Payments are taken right through our website via credit or debit card. We do not accept checks at this time. If you would like to pay via cash, please stop into Cultivated during regular business hours to make your payment. Please note that your reservation is not confirmed without payment.
Parking + Entry:
Photographers can use one (1) of the parking spaces at the rear of the building. A representative of The Loft will meet you 15 minutes prior to your reservation time to unlock the space and get you started. Your clients can park in front in any of the 2-Hour Parking spaces provided by the city and enter the space at 7 N Wisconsin Street.
Set-Up + Tear Down:
We allot for 15 minutes before and after each session for set-up and tear down. During this time we encourage photographers to move furniture, rearrange props, set-up back drops and/or lighting, as long as everything is returned to how it was when you arrived. Please figure this into your tear down time. We can keep our prices down, by you simply cleaning up the space in a timely manner. We really appreciate your understanding on this. Please contact us immediately, if there are any equipment malfunctions, damage to the property, props, or furniture, or any other issue that may arise.
Lighting:
The sun rises in the back of our building where the outdoor space and the bedroom are located. The sun sets in the front of our space with the amazing arched windows and the living room space. Please plan your shoots accordingly, taking into consideration the time of year and where the best lighting will be. We do have two studio lights for use to our photographers, to give you a little more control of lighting also.
Food + Drink:
We do provide snacks and beverages for photographers and their clients and also welcome you to bring your own. Unfortunately, alcoholic beverages are not allowed. We ask that you take care when eating and drinking in the space, as not to stain or damage props or furniture and make sure to clean up after yourselves. As an additional note, smoking + vaping are not allowed in the space, on the deck, or within 20 feet of any entrance.
Pets:
As much as we our love four-legged companions (or any other pets), we do not allow animals in the space at this time.
Cancellation Policy:
48+ Hours - Payments will be refunding less 6% processing fee.
24-48 Hours - 50% of the total rental fee will be refunded.
Less than 24 Hours - NO REFUNDS.
RENTAL TERMS:
"Company" is Cultivated LLC dba The Loft - Photo Studio; "Premises" includes the studio, restroom facilities, kitchen, and parking spaces operated by the Company; "Photographer" is the person or entity renting the Premises and equipment.
RATES:
Rental rates are set by the most current version of the Pricing Sheet in effect at the time of signing. All rates are visible at time of booking.
PAYMENTS:
In order to confirm and hold a reservation, all rental fees must be paid in full at the time of booking.
CANCELLATIONS:
Cancellations of confirmed bookings will result in the following charges:
48+ Hours Prior to Rental Date: All payments refunded less 6% processing fee.
24-48 Hours Prior to Rental Date: 50% of the total rental fee will be refunded.
Less than 24 Hours Prior to Rental Date: NO REFUNDS.
If the Company must cancel the Photographer's reservation, the Photographer will be given, in the Company's sole discretion, either rescheduling priority or a full refund. The Company is not liable for acts out of its control that affect the shoot, such as building equipment failures, power outages, weather, acts of God or emergencies. In such cases, the Company will refund a prorated portion of the Photographer's payment.
LENGTH OF USE:
Rental periods are pre-arranged at the time of booking. The Photographer's rental time begins 15 minutes prior to the reservation and ends 15 minutes after. This extra time is to be used for set up and break-down. The Studio must be cleaned and vacated by the end of the 15 minutes post session time.
CLEANING + TRASH:
The Photographer agrees to leave the Premises and all contents and fixtures in the same condition as they were when the Photographer arrived. The Company will dispose of trash collected in the supplied trash can. The Photographer must discard large items, such as personal props and set pieces, in the hallway by the back door. Disposal of large amounts of garbage due to large sets may also accrue additional costs. All items brought to the Premises by the Photographer are to be removed by the Photographer. Items left after seven (7) days will be assumed abandoned and may be discarded or kept by the Company for Company use, with no compensation due to the Photographer, at the discretion of the Company. If the Photographer does not return the Premises to the order and cleanliness found when the Photographer arrived, the Company will charge at minimum a $50 cleaning fee to be charged to the credit card on file.
STUDIO RULES:
No smoking or vaping whatsoever is allowed in the building or within 20 feet of any entrance.
No alcoholic beverages or no-prescription or illegal drugs.
Music/voices are to be kept at reasonable levels and not contain vulgar or offensive lyrics or language.
No pets allowed without prior consent of the Company.
Maximum of twelve (12) people in the Photographer's party.
WAIVER OF LIABILITY:
Use of the Company's Premises and equipment is at the Photographer's risk. The Photographer hereby agrees that the Company will not be held liable for any direct, indirect, incidental, or consequential damage, injury or loss to the Photographer, his/her party or possessions while on the Premises. The Photographer holds harmless and indemnifies the Company and its owners, agents, representatives, associates, officers, employees, guests and tenants against any suit, claim, loss, accident, judgment, fine, injury, or damages, including reasonable attorney's fees. This indemnification shall continue in full force and effect during and after the term of the rental for such causes arising during the term of the rental.
CONDUCT:
This is a shared studio and we maintain a professional environment. The Photographer shall be solely responsible for the conduct and welfare of all persons accompanying the Photographer while on Company's Premises. The Photographer agrees that a Company representative may, at the Company's sole discretion, be present at any time. If the representative observes or otherwise becomes aware of dangerous, pornographic, illegal or negligent practices or activities, the representative reserves the right to stop the shoot and may require the Photographer and the Photographer's party to leave immediately. The authorities will be alerted to any illegal activities witnessed by the Company representative. In such cases no refund will be given for unused time. However, the Company and its representatives assume no responsibility to act in such cases.
AGE OF MODELS:
The Photographer is solely responsible for verifying that all photographic subjects are of legal age or accompanied by a parent or legal guardian. The Company has no responsibility to determine or verify the age of participants in the Photographer's activities but reserves the right to demand proof of parental consent if models or photographic subjects are under the age of 18 and to end those activities if the Company becomes aware that legal age violations are occurring. The Company is not liable in the case of an invalid ID or any other form of age verification.
INSURANCE:
Businesses, Corporations, Production Companies, and other legal entities may be required, prior to rental, to present a certificate of general liability insurance naming Cultivated LLC dba The Loft - Photo Studio as additionally insured on the dates of the rental. If so required, the Photographer's liability insurance shall be deemed primary and noncontributory insurance in the event of any claim or suit. Liability insurance shall be Commercial General Liability with a minimum of $1,000,000 per occurrence and annual aggregate.
EQUIPMENT:
The Company agrees to provide equipment in good working order, but makes no special guarantees as to said equipment's functionality or suitability to the Photographer's purposes. The Photographer shall notify the Company immediately of any malfunction, damage or other issues with the equipment. There is no studio phone service provided. The Photographer is advised to bring a cell phone. WiFi internet service is available during the rental period. Code for access will be provided on the Premises.
DAMAGE:
The Photographer shall be solely responsible for any damage to the Company's property or equipment that occurs during the time the Photographer or his/her party occupies the Premises. The Photographer agrees to pay reasonable repair or replacement costs to bring damaged property or equipment back to working condition. The Photographer agrees to pay for damage to the Premises including spills, excessive wear, marks or stains on furniture, fixtures or painted surfaces.
ARBITRATION and MISCELLANY:
If the parties are unable to resolve any controversy or claim arising under this Agreement, they agree to submit the dispute or claim to binding arbitration subject to the commercial arbitration rules of the American Arbitration Association. This arbitration will take place in Walworth County, Wisconsin. The parties further agree that any such controversy or claim shall be submitted to one arbitrator selected from the panels of arbitrators of the American Arbitration Association. Each party shall be responsible for its share of the arbitration fees in accordance with the applicable Rules of Arbitration. In the event a party fails to proceed with arbitration, unsuccessfully challenges the arbitrator's award, or fails to comply with the arbitrator's award, the other party is entitled to costs of suit, including a reasonable attorney's fee for having to compel arbitration or defend or enforce the award. Notwithstanding the foregoing, either party may refuse to arbitrate when the dispute is for a sum less than $100.
The Photographer shall comply in all respects with all federal, state, county, city or other local laws, regulations, and ordinances and all rules and regulations of any governmental authority, in connection with this Agreement. This Agreement incorporates the entire understanding and agreement between the Company and the Photographer. Any modifications of this Agreement must be in writing and signed by both parties. Any waiver of a breach or default hereunder shall not be deemed a waiver of a subsequent breach or default of either the same provision or any other provision of this Agreement. The laws of the State of Wisconsin shall govern this Agreement. Signatures are collected at the time of booking.
